‘Liquidity’ research products as promoted on this website are provided by CrossBorder Capital Limited (“CrossBorder”), and Linchpin IFM Limited (“Linchpin”) in their respect acts solely as the Introducer.  CrossBorder is a member of, and is regulated in the conduct of its UK investment business by, The Financial Conduct Authority ("the FCA"). The FCA has certain rules which govern the investment business which CrossBorder carries on.  These Terms of Business constitute the terms of the agreement ("the Agreement") under which CrossBorder will deal with you when providing you with research products or services (“The Services”).  For the purpose of the FCA Rules we have categorised you as a "per se professional client" and until you advise us in writing or by email to the contrary we shall assume this categorisation is and continues to be correct.

Neither CrossBorder nor Linchpin make any promises, representations, warranties or guarantees that you will profit from using The Services or that using them will not result in a loss to you or that the results of using them will be the same for all their clients.

Whilst The Services will be provided in good faith, neither CrossBorder nor Linchpin nor any officer, employee or agent of either company shall be liable for loss or damage, whether direct or indirect, which you may suffer by using The Services, research or advice or otherwise relying on our advice or opinions. 

The research, proprietary data series and advice provided by CrossBorder as part of the Services is a property right belonging to CrossBorder and you must not disseminate such research or advice in whole or in part, directly or indirectly, to any brokers, brokers' customers, employees, agents, officers, directors or any other person, except as necessary to conduct your business or as required by any applicable law or regulation.  Where the research or advice is so disseminated you will make a written acknowledgement of the source of that research or advice to its recipient.

This Agreement shall be governed by and construed in accordance with English law and each of us submits to the nonexclusive jurisdiction of the English Courts.
